RULES
1. General provisions
These rules for the purchase and sale of goods (hereinafter - the Rules) determine the mutual rights, duties and responsibilities of the person purchasing goods in the www.careholic.eu electronic store (hereinafter - the Buyer) and MB Prabangos banga (hereinafter - the Seller) when the Buyer purchases goods in the electronic store www.careholic.eu. By purchasing goods in the online store, the Buyer agrees to the application of these Rules.
2. The moment of conclusion of the purchase - sale contract The purchase-sale agreement between the Buyer and the Seller is considered to be concluded from the moment when the Buyer, after creating a shopping cart in the electronic store, specifies all his data, familiarizes himself with the rules and clicks the "Order" button, and is valid until the full fulfillment of the obligations under this agreement.
3. Buyer's rights and obligations The rights and obligations of the parties are implemented taking into account the rules for the sale of goods and the provision of services when contracts are concluded using means of communication, approved by the Minister of Economy of the Republic of Lithuania in 2001. August 17 by order no. 258 "On the approval of the rules for the sale of goods and the provision of services when contracts are concluded using means of communication".
3.1. The buyer has the right to buy goods in the electronic store in accordance with these Rules and the legal acts of the Republic of Lithuania.
3.2. The buyer has the right to cancel the contract for the purchase and sale of goods concluded in the electronic store with the Seller, by notifying the Seller in writing within 7 working days from the day of delivery of the goods. The buyer has the right to withdraw from the contract for the purchase and sale of goods with the seller only if the goods are of high quality, have not been damaged and have not substantially changed their appearance.
3.3. The buyer has other rights provided for in the Rules and legal acts of the Republic of Lithuania.
3.4. The buyer must pay the price of the goods and their delivery, as well as other payments (if specified when concluding the contract) and accept the ordered goods.
3.5. If the data provided in the Buyer's registration form changes, the Buyer must update them immediately.
3.6. The buyer must comply with other requirements established in the Rules and legal acts of the Republic of Lithuania.
4. Seller's rights and obligations
4.1. If the Buyer tries to harm the work or stable operation of the electronic store or violates his obligations, the Seller may limit, suspend (terminate) his access to the electronic store without prior warning and is not responsible for any related losses of the Buyer.
4.2. The Seller has the right to temporarily or indefinitely terminate the operation of the electronic store without separate notice and is not responsible for any related losses of the Buyer.
4.3. The seller has the right to unilaterally change these Rules by publishing the changed Rules on the website of the electronic store. Changes take effect from the moment of publication for all transactions concluded after publication.
4.4. The seller has other rights provided for in the Rules and legal acts of the Republic of Lithuania.
4.5. The Seller undertakes to make efforts to enable the Buyer to properly use the services provided by the electronic store. The seller does not make any guarantees that the online store will operate without interruption or that data transmission will be error-free. The Seller is not responsible for any losses of the Buyer related to malfunctions of the electronic store and/or data transmission errors.
4.6. The Seller, in the event of important circumstances, being unable to provide the ordered product to the Buyer, undertakes to offer an analogous product, and if the Buyer refuses to accept the analogue of the product, to return the money paid by the Buyer for the product within 7 working days, the delivery costs are non-refundable. In this case, the Seller is released from responsibility for non-delivery of the goods.
4.7. The seller undertakes to comply with other requirements set forth in these Rules.
5. Price of goods and payment
5.1. The prices of goods placed and sold in the order of goods and in the electronic store are indicated with VAT.
5.2. The shipping fee is indicated when the order is created until it is confirmed.
5.3. The customer can pay for the ordered goods by advance bank transfer, specifying the order number.
6. Delivery of goods and guarantees
6.1. The seller carries out the delivery of goods using third parties - postal couriers. Before delivering the goods, the couriers, if necessary, have the right to contact the Buyer and check the exact time at which the Buyer will receive the delivered goods. If no other person accepting the goods is specified in the order, the Buyer must accept them himself.
6.2. In cases where the Buyer cannot accept the goods at the agreed time, he immediately informs the courier delivering the goods and the Seller by phone.
6.3. If the goods are delivered to the address specified by the Buyer and at the time agreed with him, but the Buyer cannot be found, the Buyer has no right to make claims to the Seller regarding the delivery of the goods.
6.4. The Buyer checks the quantity, nomenclature and quality of the goods at the time of delivery. When accepting the product, the Buyer must sign the product delivery documents, confirming that the product has been delivered to him.
6.5. The Buyer must submit all comments regarding obvious defects in the goods in writing when accepting the goods. Claims regarding hidden defects of the goods can be submitted by the Buyer in writing no later than within 7 (seven) days from the receipt of the goods.
6.6. The seller undertakes to deliver the goods to the address and terms specified in the order. If it turns out that the Seller cannot deliver the goods within the stipulated time, he immediately informs the Buyer about this.
6.7. After the Buyer pays for the goods, the Seller sends an invoice to the Buyer electronically.
6.8. The seller is released from responsibility for the violation of the terms of delivery of the goods, if this violation occurred due to the fault of the buyer.
6.9. The seller declares that the goods meet the usual quality requirements for these goods. The general characteristics of each item are listed in the item description attached to each item.
7. Other Provisions
7.1. The rules are drawn up in accordance with the legal acts of the Republic of Lithuania and the relations provided for in them are governed by the law of the Republic of Lithuania.
7.2. The Buyer and the Seller agree that all information provided on the Seller's e-store website is considered to have been provided to the Buyer in writing.
7.3. The parties undertake to resolve all disputes arising from the implementation of the Rules through negotiations. If the dispute is not resolved through negotiations, legal disputes are considered according to the location of the Seller's headquarters.
Personal data privacy protection
1. Each new Buyer must register by providing his personal data:
-name,
-surname,
-Phone number,
- email postal address,
- the address where the goods will be delivered.
If the Buyer is a legal entity, he must additionally provide the following data:
- company name,
-code,
- VAT payer code (if VAT payer).
The buyer who has become a Registered User (hereinafter - RV) has his own login name, password and other data.
2. The seller ensures that RV's personal data will only be used to identify RV when ordering goods and delivering the ordered goods. RV's personal data can be used for marketing purposes only if RV has expressed consent when filling out the registration form.
3. The seller undertakes not to disclose RV's personal data and information related to the order to any third parties, except for partners providing services related to the RV order.
4. The seller undertakes to ensure the protection of RV's personal data in accordance with the laws of the Republic of Lithuania.
5. The RV user undertakes to protect his login data to the online store www.careholic.eu and not to disclose them to any third party. Any breach of this condition shall be the responsibility of RV.
Delivery of goods
1. Through couriers. Orders are delivered in Lithuania between 8:00 a.m. and 6:00 p.m. workdays. If you cannot be at the delivery location at that time, please contact us or the courier. Items are delivered within 2 to 4 business days after payment confirmation.
Important: if you notice damage to the shipment, do not accept it and mark it on the shipment's waybill. Otherwise, it will be considered that the shipment was delivered in good order and you have no claims.
2. Return. If for any reason you want to return the goods, you must contact us within 7 working days of receiving the package and indicate: the order number and date; product name and code; the reason for the return (the product is damaged, etc.); expected return date.
IMPORTANT - Returned goods must be in the original packaging. Shipping costs are not refundable. Return shipping costs are paid by the Buyer.
When returning, you must include the original invoice that you receive with the product, a completed and signed written request stating the defects of the product.
The Buyer is responsible for the assembly and packaging of the item. If the item is not complete and properly packed, the Seller will not accept the returned item.
Goods will not be accepted back if they have been used and/or have been damaged and/or have lost their commercial appearance (changes to the appearance of the goods or their packaging, which were necessary to inspect the goods, are not considered essential changes to the appearance of the goods).
ATTENTION! Based on the 2001 June 29 By order of the Minister of Economy of the Republic of Lithuania regarding the approval of the rules for returning and exchanging items no. 217 point 18, the buyer's claim to replace the purchased product with similar ones or to return the money paid is not satisfied after purchasing products with codes according to the combined nomenclature of goods - 33.03 - 33.07 (perfume, cosmetics and toilet preparations)
